Any sale implies the express acceptance of the general conditions of sale listed below and in particular the granting jurisdiction clause.
When a customer places an order, he or she is deemed to be over 18 years old or to have a parental consent to place an order on the website. By his or her acceptance of these general conditions, he or she recognizes having full legal capacity to commit to a command corresponding to the normal needs of a user. In case of doubt about the order, the Shanti Association reserves the right to ask for explanations on the use that will be made of the products ordered.
The delivery period that we always try to respect are generally between 4 and 7 days and are given only as an indication; they will in no case be the subject of any claim for compensation.
Similarly, no indemnity may be claimed if a product cannot be delivered, either as a result of an unexpected stoppage in the manufacture, if the delay or non-execution of the order is due to strike, accident, fire, natural disaster, inability to obtain supplies or other causes beyond our control.
Our deliveries are currently provided by transporter in standard courier or by postal mail.
The customer commits himself to mention a "readible and complete" delivery address so that the carrier can hand over the product against signature on receipt.
In the case that the customer is not at the place of delivery previously mentioned, the customer agrees to go and pick it up directly from the transporter.
Our goods travel under the complete responsibility of the buyer, who, in case of default or damage, is responsible for making any statement to the transporter and confirm it by registered letter with acknowledgment of receipt within 24 hours.
In addition, we advise you to fax us a copy of your letter to this number +33 (0)4 68 71 18 33 in order to accelerate the opening of the litigation with the transporter.
The Shanti Association reserves the right to modify its tariffs at any time without prior notice, in particular on the basis of the prices of raw materials, packaging, possible currency fluctuations and changes in national VAT.
The buyer is obliged to check the products received at the time of delivery and must mention on the delivery note the reserves he intends to make concerning the condition of the goods received and the conformity of the goods delivered with the ones ordered : damage, etc.
No complain will be accepted after reception of the goods by the buyer if the latter did not mention it at the moment of their reception to the transporter.
PERIOD OF WITHDRAWAL
The withdrawal period in accordance with theArticle L 121-19 of the French Consumer Code is 7 days for non-professionals. Please note: The 7-day period starts at the reception of the products.
The withdrawing customer must return the goods, in their complete unused condition and will bear the return and shipping costs.
The parcel must be sent in return against signature on receipt.
The amounts paid will be refunded within 30 days by the Shanti Association, the customer can also request a credit in our accounts or an exchange of products after reception of the returned product.
If the parcel is refused on delivery by the customer after he has confirmed his order, the product will be sent back to the Association at the expense of the customer, who agrees to bear the extra charges of the return (charged 50% more than the initial transportation costs).
The guarantee is limited to the supply of the product according to our specifications.
It is limited to the simple exchange of an identical product deemed compliant and no other compensation can be claimed.
Return charges are under the responsibility and charge of the sender in all cases.
Images and pictures in our catalog are not contractual; prices are quoted inclusive of tax, subject to printing errors.
NULLITY OF A CLAUSE
If any of the clauses in these conditions would be void or made void, the remaining clauses will not be void and will continue to apply.
These general conditions of sale are ruled exclusively by the French law. For all disputes, the jurisdiction is expressly conferred only to Tribunal of First Instance of Carcassonne (Department of Aude, France).
